Course Description

This course will examine the law governing the definition of family and the rights and duties of family members to each other. In particular, the conversation will focus upon marriage and cover such topics as restrictions on who may marry, and issues incident to dissolution of marriage (property division, spousal and child support, and child custody). Students will become familiar with New York’s Marriage Equality Act related to same sex couples and be able to discuss the Defense of Marriage Act and its implications. Through introduction to New York Family statutes and case law, students will examine the rights of parents, and the rights of the child in terms of discipline, welfare, and relevant factors considered in a best interest analysis.
